The First Value is pre-lawsuit valuation. Since there is never a chance of an excess judgment above the policy limits, their insured is safe and the liability carrier knows what the max payout can be—policy limits.
The Second Value is when a lawsuit is filed. Once filed, a jury or judge ultimately controls what the final value of the car accident is. There is always a chance of an excess judgment and the carrier will always incur litigation costs and attorney fees managing the case. Regardless of whether the case is handled in-house or by outside fee counsel.
