The Most Common No-Fault Utah Car Insurance Benefits.
Personal Injury Protection Benefits (“PIP”) are Utah’s version of “NO-FAULT” car insurance benefits. Unless you purchase more, the Utah statutory PIP benefits are:
(1). Lost wages up to $250 per week or 80% whichever is less. Only after 2 consecutive weeks of missing work. [see this article on how to capture lost wages in your car accident]
(2). Medical pay up to $3,000 of related medical bills. Must be related medical bills.
(3). Special damage allowance (Household Services).
(4). Funeral, burial, or cremation benefits not to exceed a total of $1,500 per person.
(5). Compensation on account of death of a person, payable to the person’s heirs, in the total of $3,000.
See Utah Code 31A-22-307. Personal injury protection coverages and benefits.
Why are They Called No-Fault?
No-Fault car insurance benefits pay out if you are eligible, not if you are not at-fault. No-Fault car insurance is a component of the car insurance, like Underinsured, uninsured and liability coverage.
Example: You Rear-End Another Car. You rear-end the car in front of you on University Avenue in Provo, UT 84606. Even though you were at-fault for the car accident, your own car insurance policy will pay out its No-Fault benefits if you are hurt and eligible. [See this article on proving fault in a Utah car accident.]
Example: You Step Out in Front of a Car. You accidentally step out in front of a car that hits you. It is your fault for sure. You are eligible for Utah PIP benefits from the car that hit you. Even though they didn’t do anything wrong.
OTHER COMMON TYPES OF NO-FAULT BENEFITS IN UTAH
PIP benefits associated with Utah car accidents are very commonly used No-Fault insurance benefits. Other types of No-Fault insurance benefits are:
(1). Homeowners’ Insurance Policies. Nearly all residential homes have liability insurance called homeowners’ insurance. Attached to these homeowners’ policies are No-Fault benefits called MEDPAY or Medical Pay. MEDPAY is designed to pay for medical bills when people are injured on your property, regardless of who was at-fault for the injury.
Examples include someone falling off your deck while drunk. Or slips on the way up to your house on the stairs.
(2). Commercial Premise Liability Policies. Convenience stores, grocers and retail stores all have commercial policies of liability insurance. Within and attached to those policies often are No-Fault MEDPAY or Medical Pay benefits.
Each of these types of premise liability insurance policies often have No-Fault benefits attached to them.
